Principles of Instructional Design Essay Client – The client is a company known as Delta Computers, which manufactures computers and peripherals. This is a mid-sized 20-year-old company with 2,000 employees worldwide. It has annual sales of $90 million. Its sales force is 400 in number. Of these about 100 are senior sales managers and directors, and the remaining 300 are the frontline sales force consisting of sales executives.   The sales executives make sales calls, both in person and by telephone, to various companies to sell the company’s products. Data Collection – The first step in the creation of the e-learning course is to collect all the information that is required to create an effective e-learning course. There are various data collection techniques, such as interviewing, questionnaires, focus group questionnaires, observation, Internet, and libraries. The Instructional Designer (ID) can conduct an interview with the Senior Sales Managers of Delta Computers to get information about various sales techniques, which they want their employees to learn and which are relevant to their business. They can also gather information from freely available sources on the Internet and libraries, and also existing content about sales techniques that the company may have, created by their erstwhile and present sales managers. They can also send a questionnaire to the Senior Sales Managers seeking the following information that would be required for creating the course. 1. Who is the audience for this course? (Managers, Sales Executives, Directors, Engineers, Administrative employees, Sales Managers) 2. What is the age group of the learners? 3. What are the qualifications of the learners of this course? (High School, Graduate, Engineering Graduate, Management Graduate) 3. What is the means by which the learners will access this course? (Home computer, office computer, Internet, CD) 4. What is the goal of the course or what purpose does the course seek to accomplish? 5. What is the existing knowledge that the learners have about this topic? (Beginners, experts, proficient) 6. Is the goal you seek to accomplish through this course measurable, if so what are the quantities? 7. How many people will access this course per month? 8. How much time can the learners devote to this course per week? 9. Would you like the performance of the learners to be scored at the end of the course? 10. Typically, the passing score of a learner is 80%. What would you like the passing score of the learner to be? 11. Would you want the learner to undergo the complete course again if he or she fails, or would you like them to undergo only the part in which they have failed again? 12. What is the level of technical knowledge of the learners, i.e. do they know how to operate computers, email, Internet? (Beginner, expert, proficient) 13. Within what duration would you like the learner to complete the course? 14. Would you want more interactivity, simulations, graphics, and fun element in the course or would you want the course to be factual and to the point with minimal graphics and fun element? 15. Analysis – After the required information has been collected, the analysis for the e-learning course would be done. The analysis would include: 1. Learning needs analysis, 2. Goals of the course. 3. Learning gap. 4. Audience analysis. 5. Prerequisites of course. 6. Learning environment. 7. Passing criteria. 8. Objectives of the course. A detailed analysis and design document is created, which is then sent to the client for approval. After the client provides their approval on the document, the storyboarding for the e-learning course is started. Learning needs analysis – After interviews with the senior managers and from the information acquired through the questionnaire, the learning needs are determined. The senior managers of Delta Computers state that most of their sales executives who make customers calls either through telephone or personally come from varied backgrounds. The current information about sales techniques that they have is gained through the Powerpoint presentations created by the erstwhile and present sales and marketing managers of the company for internal training purposes. When a new sales employee joins, he or she is asked to read these presentations. The information in these presentations, which number about 20, is old and also there is no evaluation at the end of the presentations. The information is organized haphazardly and there are very little graphics and interactivity. The information is also outdated. Learning goals – After understanding the current level of knowledge, the ID gets information about the goals of the course. In this case, Delta Computers wants their sales executives who actually make customer calls to learn the latest sales techniques so they can close many more deals successfully. Learning gap analysis – The ID then chalks out in detail what is the gap between the learning goals and the current level of learning. The ID is able to understand that the existing information about sales techniques is generally what the Senior Sales Managers had put down informally on presentations. The information is haphazardly structured, out-of-date, incomplete, and uninterestingly presented. The ID proposes to get information on latest sales techniques by interviewing the Senior Sales Managers and Sales Directors of the company and other outside sales experts, and through books, journals, and Internet articles. Audience Analysis – After the learning gap analysis, the audience for the course is analyzed. From the information obtained from the answers to the questionnaire submitted to Delta Computers, the ID is able to understand the profile of the learner of this course. The learners who will undergo this course are males and females belonging to the age group of 24 to 55 years. They are mostly graduates in various disciplines, including arts, sciences, and management. About 5% of them are engineering graduates in various disciplines and 10% have obtained management degrees in sales and marketing. They are all computer and Internet savvy and 10% of them have their personal laptops. Prerequisites of the course – The ID formulates certain prerequisites for undertaking the course. The learners should all have basic knowledge of computers, Internet, and English language. They should also have adequate knowledge about the various products in the portfolio of Delta Computers and the features and benefits of the products. Learning environment – The learners will undertake the course through the company’s Learning Management System (LMS). This will be an online course and each learner will be provided a login ID to log in to the LMS. The hardware requirements would be minimum Pentium IV configuration, 2.40 GHz, and 256 MB RAM with broadband Internet. Passing criteria – The learner will need to score a minimum of 80% in the assessment to pass the course. If they are unable to do so, they will have to undertake the course again. Terminal objectives – The next step is to divide the course content into modules and topics and to formulate the terminal objectives for each module of the course. The name of the course is â€Å"Sales Techniques to Make Effective Sales.† The five levels of Bloom’s taxonomy are knowledge, comprehension, application, analysis, synthesis, and evaluation. The five learning types according to Gagne are verbal information, intellectual skills, cognitive strategies, motor skills, and attitudes.

The War Of 1812 How And Why History Essay The United States declared its independence from Great Britain in 1776 and won its independence in 1783. The United States Constitution comes into play and George Washington becomes the first United States President in 1789. In 1793 war breaks out between Britain and France. Thomas Jefferson oversees the purchase of the Louisiana Territory from France in 1803. The United States was worried about the war between France and Great Britain. Britain and France were at war with each other, as was much of the rest of Europe. Both sides thought that American ships were supplying the other with food, weapons, and other supplies. American ships were routinely stopped by both France and Britain. Each demanded to search the cargo holds. A lot of times these situations ended in violence. In 1807 Britain imposed the Orders in Council that restricted American shipping and Congress passed the Embargo Act cutting off trade with Britain. It was hoped that it would punish the two nations, who were at w ar with each other, but it backfired and hurt the United States. The War of 1812 has also sometimes been called, The Forgotten War along with the Second Revolutionary War. President Harry Truman called it the silliest damn war we ever had. (Nardo, 2000) It was a war between America and Great Britain. It was caused in part by disagreements over shipping and trade on the high seas and the kidnapping of American sailors who were forced to serve in the British navy. Support in the United States was divided with the West and South looking for a fight, but people of the New England strongly opposed to war. As the war continued, opposition became much stronger. The War Hawks in Congress pushed fighting and President James Madison was steered toward asking Congress for a declaration of war. The United States declared war on Great Britain during its war with France on June 18, 1812. In 1794 the United States Constitution provided for the introduction of a navy. Congress passed a bill giving permission to build six navy ships. One of these was the U.S.S. Constitution. Constructed over a period of three years at the cost of $318,719 it was the second largest warship. (Howes, 2002) The U.S.S. Constitution never lost a battle. During the War of 1812, the Constitution sunk a large number of ships belonging to the British navy. The Constitution commanded by Captain Isaac Hull, got its nickname, Old Ironsides. when a British seaman saw one of his cannon balls hit the wooden hull of the U.S.S. Constitution, bounce off, and fall into the sea. In amazement, the seaman said, Huzzah, her sides are made of iron! (Howes, 2002) Old Ironsides captured 24 enemy vessels. The first major battle of the War of 1812 ended in disaster for the United States when General William Hull who was leading an American army of 2200 men, surrendered to British forces at Detroit without firing a shot. One American soldier, Private Nathaniel Adams, later wrote to his brother, we could have whipped the hell out of the rascals but General Hull has proved himself a traitor and a coward. (Nardo, 2000) Two years later General Hull was sentenced to death for cowardice, but the 61-year-old Revolutionary War veteran was later pardoned by President James Madison. The next battle called for troops to cross the Niagara River into Canada. An American army of 6,000 men commanded by General Stephen Van Rensselaer invaded Canada crossing the Niagara River at Queenston. The Canadian Army commanded by British General Isaac Brock attacked the Americans while they were in the process of crossing the river. Van Rensselaer unwisely divided his forces and Brocks army cut most of a group of 800 Americans to pieces while the rest of the army stood idly by only a few miles away. General Brock took a shot in the chest and was killed in the battle. (Nardo, 2000) In October of 1812, Captain Stephen Decatur, commanding the USS United States, captured the Macedonian, a British warship, near the Madeira Islands off the coast of North Africa. And in December of that same year James Madison is elected to a second term as president of the United States. He receives 128 votes in the Electoral College. Opponents of a second war with Great Britain had revived the Federalist organization, and Federalists from eleven states met in New York and agreed to support De Witt Clinton, not on account of his war views, which were not in accord with their own, but as a protest against the policy of Madison. De Witt Clinton, representing the Federalist Party, receives 89 votes. Elbridge Gerry is elected vice-president and dies two years later while still in office. (Renwick, 1845) Those events led to the Battle of Lake Erie where Captain Oliver Hazard Perry leads a fleet of eleven ships against a British fleet of six vessels on Lake Erie. Eight minutes after Perry broke the British line the ships one by one ran up their white flags. Perry had snatched victory from what had seemed a certain defeat. It was the first time that an entire British fleet had been captured. And with Lake Erie now controlled by the Americans, the British were no longer able to get supplies. Perry announces the American victory in a memorable dispatch on the back of an old envelope to headquarters: We have met the enemy and they are ours. (Greenblatt, 1994) The way was open at last for Harrison to invade Upper Canada and to recapture Detroit and in September of 1813, General William Henry Harrison led a force of 4,500 Americans across the recently secured Lake Erie in pursuit of British troops forced to abandon Detroit. On October 5th, Harrison defeated the enemy at Moravian Town to defeat the British and their Indian allies in the Battle of the Thames. Tecumseh, the Shawnee leader of the Pan-Indian confederation earlier defeated at Tippecanoe, is killed in the battle, leading many of Britains Indian allies to abandon the alliance. (Freehoff, 1996) In the same month in Europe, Napoleons French army is crushed at the Battle of Leipzig. Napoleon, forced to retreat from Russia in 1812 after seeing 400,000 of his men killed and 100,000 captured in an ill-fated invasion, sends a new but untrained army into battle against a coalition of European nations at Leipzig, suffering another defeat that forces his retreat back into France. Soon after their victory at Leipzig the allies offered Napoleon peace under which France boundaries would be the Rhine and the Alps. Napoleon ignored the offer and the allies began a coordinated campaign that made its way through France. Napoleon was defeated in a series of battles each bringing the allies closer to Paris. On March 31, 1814 a victorious allied army entered Paris, and French foreign minister Talleyrand influenced the Senate to declare that Napoleon had forfeited the throne. On April 11th he abdicated the throne to the allies who gave him the island of Elba as his own sovereign principality with an annual income of 2,000,000 francs. (Cronin, 1994) Direct talks between the United States and Great Britain, proposed by the British foreign minister, Lord Castlereagh, began in Ghent. The American delegation consisted of Albert Gallatin, James Bayard, John Quincy Adams, Henry Clay, and Jonathan Russell. As the British army of approximately 4,000 approached, the majority of Washington residents fled the city. (Coles, 1965) On August 24th American defenders, with President James Madison in attendance, were quickly routed by the invaders in a battle at Bladensburg a few miles from the city. A messenger was dispatched to the White House to warn First Lady Dolly Madison of the arrival of the British. She and her staff fled by carriage across the Potomac but not without taking with her the full-length portrait of George Washington painted by Gilbert Stuart. It had been necessary for her servant to chop the frame apart with a hatchet in order to remove the canvas. (Greenblatt, 1994) That evening, the vanguard of the British army reached Capitol Hill and began its systematic destruction of all public buildings in the city. British forces captured Washington, D.C. The White House, the Capitol, and executive department offices are burned. Secretary of War John Armstrong was blamed for the poo r planning and intelligence that left Americas capital poorly defended and was forced to resign. After capturing and burning Washington so easily, the British didnt think they would have any trouble taking Baltimore. They figured they would sail their ships right into the harbor and destroy Fort McHenry with cannon fire making way for a land assault on the city. But the British attack on the capital had given the Americans time to prepare for them with more than 16,000 troops and thousands of civilians. When General Ross tried to attack by land he was killed and his troops driven back. A Washington lawyer named Francis Scott Key witnessed the action from a boat about 8 miles away catching glimpses of the bright stripes and bright stars of the forts flag lit up by the rockets red glare. (Nardo, 2000) The sight inspired him to write The Star-Spangled Banner to the tune of an old British drinking song. The song became the national anthem of the United Stated in 1931. During the Battle of Plattsburg on Lake Champlain in September of 1814, American forces turned back a British army of 11,000 men under the command of Sir George Prevost at Lake Champlain, New York. The Americans, who were outnumbered three to one established superior positions on the lake and shoreline, forcing Prevost to withdraw from the field. In the wake of his defeat, Prevost abandoned his invasion and retreated to Canada. The American victory saved New York from possible invasion and helped lead to the conclusion of peace negotiations between Britain and the United States in Ghent, Belgium. The Hartford Convention convenes as Federalist delegates from Massachusetts, Connecticut, Vermont, New Hampshire, and Rhode Island meet to discuss their opposition to the war. There is speculation that the convention will recommend New Englands secession from the United States and the negotiation of a separate peace with Britain. Instead, the delegates propose constitutional amendments requiring a two-thirds vote for declarations of war and laws restricting commerce, forbidding successive presidents from the same state, eliminating the three-fifths clause, and restricting future presidents to one term in office. These proposals will reach Washington just weeks before the end of the war. The War of 1812 ended when the Treaty of Ghent was signed at the end of 1814, guaranteeing that the United States and Britain would end their battle. Neither side was able to claim complete victory and they continued fighting for several more weeks. The Treaty of Ghent had come too late to prevent the slaughter in New Orleans. Two weeks after negotiators in Europe reached an agreement on a peace treaty to end the War of 1812, but a month before news of the treaty reaches North America, the United States won its greatest military victory of the conflict. The Battle of New Orleans was a prolonged battle and was the final major battle of the War of 1812. American forces, commanded by General Andrew Jackson, defeated an invading British Army intent on seizing New Orleans and the vast territory America had acquired with the Louisiana Purchase. The battle is often regarded as the greatest American land victory of the war. Speedy communication would have eliminated this battle. The War of 1812 could be called the war of poor communication. (Coles, 1965) It had no impact on the final settlement. The war to me didnt seem to accomplish much of anything. It seemed to be a whole bunch of failures in my opinion. I dont think they were prepared at all and things quickly went from bad to worse. I do believe that the war brought a patriotic feeling to the Americans and they gained some confidence and maybe even some respect from other nations that helped commerce to expand to other nations. It didnt really solve any of the problems that they went to war over but it did cause expansion and nationalism.

Philosophical Theantropy as the Principle of Religious Ecumenism ABSTRACT: One universal constituent element of human consciousness is belief in the existence of a divine reality that is experienced by persons as the most intimate and essential part of human life. Belief in transcendent reality, which is an immanent part of human nature, constitutes an awe-inspiring mystery (mysterium fascinans et tremens) — that is, a theantropy. Strictly speaking, ‘theantropy’ is a theological term which is used to express the "union of the divine and human natures in Christ" (as defined by Webster’s New Collegiate Dictionary). The novum of my understanding of theantropy consists in the application of the concept to the phenomenological experience of the religious consciousness of humanity. Henceforth, I designate theantropy to mean an ontic union and an inherent disposition of the ‘human’ and ‘divine’ constituents in/of every human being. I will examine and reflect on theantropy as the philosophical principle of religious ecumenism as well as compare various solutions of theantropy not only with regard to a particular system of beliefs, but as it is experienced in each and every human being by following Augustine’s principle: "In interiorem hominem redi: ibi habitat Deus" (or in "intimor intimo meo"). In each and every human being, there is a specific polarization between the human and the divine dimensions, which one can call theantropy. In the strict sense 'theantropy' is a theological term, and is employed to express "the union of the divine and human natures in Christ." The novum of this author's understanding of the term 'theantropy' consists of the application of this concept to the phenomenological experience of religious consciousness of man. Henceforth, in this paper, 'theantropy' means "an ontic union and an inherent disposition of the 'human' and the 'divine' constituents in/of each and every human being." Theantropy so understood, can be described as a perpetual striving of man for unity with the 'Inner-Word' of human soul for establishing one spiritual oikoumenÈ of all people into one divine community of believers (Cf I Pe.:2,5; Eph.:2,19; I Tim.:3.15; He.:3,6; etc.). Referring to the Gospel of St. John, St. Augustine writes: I implore you to love with me and, by believing, to run with me; let us long for our heavenly country , let us sigh for our heavenly home, let us truly feel that here we are strangers. What shall we then see? Let the gospel tell us: 'In the beginning was the Word and the Word was with God and the Word was God. William T. Sherman SHERMAN, William Tecumseh (1820-91). Ranked second only to General Ulysses S. Grant as the greatest Northern commander in the American Civil War, Gen. William Tecumseh Sherman was a master of modern warfare. Like Grant, Sherman was born in Ohio when it was a frontier state. He was named Tecumseh for the Shawnee Indian chief who had terrorized that region a few years earlier. Sherman was born on Feb. 8, 1820, in Lancaster, Ohio. His father died when he was 9 years old. Most of the 11 children in the family were distributed among the relatives and friends. He was adopted by Thomas Ewing. After attending an academy at Lancaster, Sherman entered West Point. During the Mexican War he saw service in California. In 1853 he resigned his commission for a business, legal, and educational career. When Louisiana seceded from the Union, he was head of the state military academy (now Louisiana State University). He resigned his position and rejoined the army in May 1861. He was commissioned a colonel of volunteers and commanded a brigade in the first battle of Bull Run, on July 21, 1861. Three months later he was given charge of the Department of the Ohio (River). On taking over his new command he reported that 200,000 men would be needed to carry on a successful campaign in that region. Newspapers said that Sherman was crazy. ARGUMENT Angelina Jolie, even the name has a certain rhythm to it. Love or hate her, you cannot be indifferent about her. To say she is a goddess is stating the obvious. Has there ever been a more talked about woman since Princess Diana? It is hard to believe that she only just turned 38, she has achieved in those years what most people will never achieve if they lived to be 100 years. There is no question that Angelina is a trailblazer, always a leader and never a follower.Contrary to opinions that the media has shown over time, she is not afraid to speak and live honestly. The media has created an image of an Angelina that bears no resemblance to who she is, the tabloids especially have turned her life into a soap opera and creating drama where none exists. The tabloids have been especially vicious in their relentless attack on this woman. I ask myself why? What is it about this woman that so threaten other women. As one columnist so succinctly put it, â€Å"Angelina does not make us feel good about ourself. This is a woman who at the age of 26 adopted a child while most of her peers have been parroting to the media about wanting to be a mother, Jolie doesn’t just talk the talk, she walks the walk. Yes adoption has been going on long before she adopted, but she made it cool and acceptable. She has immersed herself in her humanitarian work, earning her kudos and respect from the experts in the field, she donates one third of her income to so many different charitable organizations around the world. Not only does she give money, she gives her time and her heart.It is a pilot. In my opinion, not many actresses can be pilots. Most insecure, self absorbed people cannot relate to her because she is not a train wreck. People can look at the train wrecks that are other women and feel sorry for them and happily say to themselves:’Thank God my life is not that bad, thank God I am a better mother†, but that cannot be said about Jolie. She is a wonde rful mother, a wonderful and loving partner, daughter and sister. The media tries to portray an image of a cold and controlling woman, but yet gain the facts do not bear that out. Everybody that has ever met her always say how sweet and down to earth she is, even Brad Pitt, poor man, did not know what hit him when he met her because the Angelina he met was the real Angelina and not the version created by the media. Angelina is that rare actress that is taken serious both in Hollywood and Washington DC. The media try to create a caricature of her authentic self in an effort assure their readers that one person cannot have it all.At this point, she and Brad Pitt have baffled the tabloid and fiction writers who proclaimed that this union will not last more than six months, here they are going into their third year with four children and more being planned for. To read some of the blogs with the bitter women claiming they are over Brangelina, and yet everywhere they show up, the crowd s well, applauding them. Maybe the tabloids need to get with the program that more people want this couple to succeed.We are constantly told she was a wild child or all the crazy stuff she did seven to ten years ago with her ex husband, funny nobody says anything about BBT’s behavior from back then considering that he was old enough to be her father. Drew Barrymore was a wild child doing drugs and clubbing at the tender age of 10, and let us not forget about Johnny Depp trashing hotel rooms, but of course they are not Angelina Jolie and there is always one rule for her and a different one for everyone else.Angelina is an enigmatic figure, very intelligent, very passionate and highly opinionated, I can’t say I blame Brad for falling in love with this gem of a woman. Her beauty shines from within. The tabloids have been throwing everything they can at her right now, hoping that they can break her, but my gut feeling is that seeing what she has seen in the refugee camps and the war torn countries she has visited, she has a better perspective in life, she is able to see the bigger picture and that is why her detractors will never get to her because she is on a much higher plane.I have a feeling that we will still be talking about this woman 50 years from now, long after the pity party has ended and the fake girl next door has been exposed for the fraud that she is. In the mean time, Angelina will continue to live her life with such poise, class and dignity. She has inspired people the world over by choosing a purpose driven life over a narcissistic and self absorbed one, her critics could learn a thing or two about making the world a little better instead of polluting it with their nastiness and ugly behavior. General OverviewAngelina Jolie first became aware of the world wide humanitarian crisis while filming Tomb Raider in Colombia. This made her turn to the office of the United Nations High Commission for Refugees (UNHCR). Her quest was to request t he agency to mandate her involvement in the protection and care for the refugees (Bruce, 2011). Jolie has been involved in the missionary work since 2001. She moved and met refugees and internally displace person in over 20 countries. The countries include: Tanzania, Sierra Leone, Thailand and many more. The most recent was when she traveled to Haiti to console and help earthquake victims (Apostolina, 2006).The ‘Jolie-Pitt Foundation’ was dedicated to the eradication of extreme rural poverty as well as protecting natural resources. In order to achieve her goals, Jolie has been instrumental in recruiting and training established therapist who are responsible in treatment of trauma. Personal relationship with the children is to help them develop interpersonal relationship and develop a positive attitude.In addition, personal relationship is essential because children will learn how to address the root cause of their vulnerability. Moreover, the foundation workers will also be in a position to know how to start helping the children. Jolie has received world wide recognition for her involvement in Humanitarian work. For instance, in 2003, Jolie was the firs recipient of the Citizen of the World award. The ward was a creation of the United Nations Correspondents Association (GaneshaSpeak, 2011). In addition, the president of Cambodia awarded Jolie citizenship of his country following her committed humanitarian support.Jolie made open her motives for joining the humanitarian field in 2001. Her message was instrumental in the provision of humanitarian aid. Joie said that it wa s unfair to sit and watch as we ignore information regarding the fact that millions of individuals were out suffering. She said how much she wanted to help. She was inspired by the feeling that all are human and we all can have the same feeling at some point (GaneshaSpeak, 2011). Contract Performance Essay

The allegation that the bidder cannot perform contract involves bidder responsibility, affirmative determination of which is not reviewed by GAO except in cases of fraud of misapplication of definitive responsibility criteria set forth in solicitation. Since neither exception is applicable, protest is dismissed (1981. pp 1-2). Explicate the regulatory provision (FAR) pertaining to contract performance in general. Contract performance first lies the early stages of interpreting the contract. Marshall Engelbeck states â€Å"The cardinal rule of contract interpretation is to â€Å"carry out the original intent of the parties. This rule is founded in common law. † (Engelbeck, 2002, p. 339) The first step in understanding a contract is interpreting the contract by finding the â€Å"plain meaning of the words, if the words are clear and unambiguous. † (O’Connor, 2007, p. 119) to help with this Marshal Engelbeck lays out six presumptions upon which a contract is founded. These are used to help interpret the contract to ensure the objective intent is understood and that no ambiguity exists between the contracting parties. They are: (1) Performance feasibility: there is a presumption that it is possible to perform the work. 2) Competency: The seller has an obligation to perform the work satisfactorily. (3) Document soundness: The contract is the plain meaning between the buyer and the seller, and should be a complete and accurate expression of the original intent of both parties. (4) Cooperation: This presumption enforces the duty on both parties to cooperate. (5) Absence of mistake: In a contract, mistakes can occur that are classified as mutual or unilateral. The burden of resulting from a mistake can be substantial, and the parties must resolve the situation quickly. 6) Conscionability: misunderstandings, and optimistic analysis can create contract requirements that impose an obligation on the performing party to operate contract to its best interest, the cost of performance is not proportional to the benefits. (2002, pp. 328-329) Also both parties are subject to the â€Å"duty to inquire rule, this applies only to obvious errors, gross discrepancies, or inadvertent and glaring gaps. This is not to focus on intent but whether either party, failing to divulge mistakes, stands to profit from the failure. † (Engelbeck, 2002, p. 339) The question stated in plain words: What does the contract say? To understand this possible additional layer in the contract, we need to use the secondary rules of contract interpretation. They are as follows: â€Å"Requirement 1: For words to be ambiguous, there must be two reasonable interpretations of the words† O’Connor (2007, p. 123), which means â€Å"the party must read the contract as a whole, words and meanings should remain consistent. † Engelbeck (2002, p. 340) â€Å"Requirement 2: The ambiguity must be hidden (patent)† (O’Connor, 2007, p. 123) which Engelbeck states as where â€Å"express language rule prevails; this rule assumes that the professionals understand the language of their own specialties. (Engelbeck, 2002, p. 340) â€Å"Requirement 3: The contractor did not know that the government had different interpretation. If a bidder knows its interpretation is in conflict with government’s at the solicitation stage, the bidder is must resolve it. † (O’Connor, 2007, p. 125) this is reinforced by Engelbeck (2002, p. 341) â€Å"knowledge of the other party’s interpretation: Entering into a contract knowing the other party’s interpretation was objectionable means that other party’s interpretation is the one that is binding. If the parties still have not resolved the inconsistencies of the contract the FAR has established and Order of Precedence to help mitigate any ambiguity that may arise from the objective intent of a contract: FAR 52. 215-8, Order of Precedence – Uniform Contract Format (October 1997), â€Å"Any inconsistency in the solicitation of contract shall be resolved by giving precedence in the following order: (a) The schedule (excluding the specifications). b) Representations and other instructions. (c) Contract clauses. (d) Other documents, exhibits, and attachments. (e) The specifications. † (O’Connor, 2007, p. 127) The Post-Award Conference is should be established by the Contracting Officer or to help â€Å"establish the communication protocol, and define the focal points for specific tasks and to ensure the contractor has a complete understanding of the scope, technical requirements, and obligations under the contract. The orientation should be held as soon after the award of the contract. † Engelbeck (2002, pp. 336-337) Engelbeck further states this is not the time to rewrite the requirements or the contract. Based off my experience as a procurement manger this is the time where possible concerns are raised by the contractor, and the task orders are issued by the contracting officer to clarify the contract, and at times modifications are issued to the contract to reflect the elucidation of the objective of the client. Explicate the regulatory provisions (FAR) that apply to the particular contract performance issue of the report chosen. The regulatory provisions that apply to this contract based off Lancer Clothing Corporation’s protest would be the following presumptions as identified by Engelbeck (1) performance feasibility, would go the argument that Lancer Clothing Corporation protests on the this issue as â€Å"the procurement objective would not be fulfilled and the significant financial lost on the part of the client could occur. Explore how love and lovers is presented in Romeo and Juliet and The Labrotory. Love. Love is a feeling of a deep romantic or sexual attachment to someone, An intense feeling of deep affection. Love in Romeo and Juliet is a brutal, powerful emotion that captures individuals and catapults them against their world, and at times, against themselves. In The Laboratory love is presented as a unpleasant feeling, filled with jealousy, obsession and overall revenge, which is also a dramatic monologue which evokes the audiences emotions. Love is another important thematic ingredient in Romeo and Juliet, which presents various types of love: the sensual, physical love embraced by the Nurse; the Traditional or contractual love represented by Paris; and the passionate, romantic love of Romeo and Juliet. †love is Too rude, Too boist’rous, and it pricks like a thorn†. In The laboratory Browning explores the jealousy and vengeful of someone disappointed in love, and how far they would travel to be happy themselves and see their lover suffer who has previously made her suffer. In the opening scene of Romeo and Juliet we are introduced to Romeo and Benvolio. Romeo reminisces about Rosaline which evokes the lover’s experience of daydreaming about his beloved, but in such a jumbled way, that it’s more frustrating than enjoyable.†Mis-shapen chaos of well-seeming forms† However this scene presents that Romeo is in love with Rosalines beauty. Romeo receives unrequited love which makes him feel melancholy and depressed. This can also be described as fickle love as he falls in and out love quickly. Romeo is in love with Rosaline at the start of the play, which is presented as an immature infatuation. Today, we might use the term â€Å"puppy love† to describe this. Romeo’s love for Rosaline is shallow and nobody really believes that it will last, including Friar Laurence. †Thou chid’st me oft for loving Rosaline† Romeo is speaking in rhyme throughout this scene. He says, â€Å"Love is a smoke made with the fume of sighs, Being purged, a fire sparkling in lovers’ eyes†. From this the reader may assume that Romeo takes love very seriously, it is also represents a stereotypical form of love poetry. This may indicate that there is nothing special about his love with Rosaline. In this scene Romeo also uses oxymoron’s to describe his love for Rosaline. He describes love as â€Å"sick health†. This illustrates the idea that he is confused and not making any sense because he is talking in an irrational way. Benvolio tells Romeo to â€Å"Examine other beauties†. This quotationportrays the idea that maybe Benvolio has seen this before from Romeo and he knows the time will come when Romeo will fall in love with another lady. The audience will feel that Romeo is acting like a lovesick teenager. Likewise in The Laboratory the women is suffering from unrequited love and is consumed with evil and twisted thoughts. She’s feeling betrayed and paranoid – she refers back to them as laughing at her, imagining her at church praying for her lover to return back to her. †While they laugh, laugh at me, at me fled to the dearer† William Shakespeare and Robert Browning both portray unrequited love and the different paths it leads to, as in Romeo and Juliet, Romeo is melancholy and sulking, however he is not doing anything to make the situation better. †Out of her favor where I am in love† In The Laboratory the women is creating a deadly poison due to her partner cheating on her and her receiving unrequited love. The women deals with the situation in a very pitiless, demanding way. †Grind away, moisten and mash up thy paste† Love between Romeo and Juliet is the main love portrayed in the play. Our classic idea of romantic love is embodied in Romeo and Juliet. Shakespeare presents this as a force of nature, so strong that it transcends societal conventions. This idea is established in the play’s prologue with the line â€Å"a pair of star-crossed lovers take their life.† Romeo and Juliet still love each other and don’t let their hatred of each other’s family get in the way of their love. â€Å"Love give me strength, and strength shall help afford†. Romeo being hurt and melancholy at the beginning of the place make the audience question does he truly feel love or not. Romeo falls for Juliet as soon as he sees her, Which Shakespeare describes as love at first sight. â€Å"Did my heart love till now?† Shake spare also portrays that Romeo falls in love with Rosalines and Juliets appearances, due to it being love at first sight. He describes Rosaline as the moon which is beautiful but the moon always goes down when the sun rises who is Juliet. †As a rich jewel in an Ethiop’s ear-Beauty too rich for use, for earth too dear† The same as in The Laboratory the women believes her ex partner has feel in love with not the women’s personality but her looks. †Shes not little, no minion like me!, That why she ensnared him: this will never free† Both play and poem portray that the men have fell in love with the women’s looks. Romeo falls for Juliet as soon as he sees her which obviously tells the readers that he fell in love at first sight with her beautiful face, likewise the man has cheated on left his partner to be with a more curvy women, again falling for her looks. A love we are introduced to in Romeo and Juliet is the love between Juliet and the Nurse which is such of a mother and daughter, It portrays warmth, trust and laughter. Juliet loves her mother in a dutiful daughter way, but they do not have a warm, close relationship. All the nurse wants is for Juliet to be happy and this is why she helps in forgetting the family feud and helping Juliet marry Romeo. This effect Shakespeare portrays adds great effect and makes the relationship between Juliet and the Nurse similar to if the Nurse was the actual mother of Juliet. â€Å"I nursed her daughter that you talked withal†. In the Laboratory no such love is presented. Its as if the women is alone in the world which is causing her to go insane. However it could also be said that the women is confiding in the old man, as he is the only one who knows about her plan as did the nurse with Juliet’s plan. She is so thrilled with her plan, she celebrates with the apothecary. †You may kiss me, old man, on my mouth if you will!† Both Shake spare and Browning portray love in similar but different ways. Juliets affection with the nurse is positive and merry, with girlish talks, However The women in The Laboratory is showing love to the old man just for full filling her evil command. In The Laboratory and Romeo and Juliet tradition plays a very large role. Paris’ love for Juliet in Romeo and Juliet is born out of tradition, not passion. He has identified her as a good candidate for a wife and approaches her father to arrange the marriage. Although this was the tradition at the time, it also says something about Paris’ staid attitude towards love. †Younger than she are happy mothers made.† Also in The Laboratory Browning does not make any direct or uniform attacks on organized religion. He does not use any references to religion or tradition as it would of made the poem calm, and without them it gives the poem a more horrific, evil tone. Many of the friendships in the play are as sincere as Romeo and Juliet’s love for one another. The close relationships between Juliet and her Nurse, and between Romeo, Mercutio and Benvolio are meaningful and heartfelt. They care deeply for another and protect each others honor – this ultimately costs Mercutio his life. This platonic love is offset by the sexual innuendos made by some characters – particularly Juliet’s Nurse and Mercutio. Their view of love is earthy and purely sexual, creating an effective contrast with Romeo and Juliet’s romanticism. At the beginning of Romeo and Juliet, Romeo is very upset which gives Mercutio and opportunity to involve humor and sex. â€Å"O’er ladies lips, who’s straight on kisses dream†. He uses more sexual innuendo throughout the play when the subject of love is mentioned. The Nurse also links love and sex throughout the play. This is more marked when she finds out Juliet is to marry Romeo. We can see how excited she is about the physical opportunity for Juliet because she comments immediately on Romeo’s physical traits. â€Å"†¦His face be better than any man’s†. Although both Mercutio and the Nurse refer to the sexual act, the Nurse’s language is crude and lacks the refinement of Mercutio’s wit. Here Shakespeare presents to us a member of the lower classes, deprived from a formal education. Also Juliet awaits Romeo to consummate their marriage, she refers wholeheartedly to her sexual desires – having ‘bought the mansion of a love, but not yet possessed it’ suggesting that she recognizes the contractual element of marriage and desires to experience the physical side. Juliet also refers to ‘white as snow on a raven’s back’ which implies that her virginal purity is set against the darkness of the blood that she will lose as her hymen is split. Love is portrayed, therefore, as being courtly and flirtatious in the early scenes but sexual and foreshadowing death in the later scenes. In The Laboratory there is no use of sexual language however the women believes that her partner and the women Elise commit sexual acts. †Where they are, what they do: they believe my tears flow† The word flow could also be described as the women crying a river. Her tears as soon dried up and is happy by the end at the death of her rival and suffering of her lover. The language used in the Laboratory has various features such as; alliteration, personification, metaphor etc. Alliteration is used to add affect and give the reader a repetitive sound. â€Å"brand, burn up, bite†, â€Å"moisten and mash†, â€Å"poison to poison thee, prithee† Also the use of exclamation marks shows excitement, and reinforces the delight. In the same way Shake pare has also used various literary devices. such as oxymoron’s †Poor living corpse, closed in a dead man’s tomb!† Dramatic irony, †indeed, I never shall be satisfied / With Romeo, till I behold him-dead- † etc. Poison is often the weapon of choice for female killers. It requires little or no physical strength to administer, and can be done secretly. It also leaves little evidence thus making it difficult to detect the culprit. In both Romeo and Juliet and The laboratory the females use poison, which leads to death. However Juliet also dies by suicide. and the women in The laboratory dies from the poison. Browning writes ‘The delicate droplet, my whole fortunes fee’ showing that she’s incredibly dedicated in getting this guy and she’s spent her whole fortune on the poison and she’s not going to give up until the deed is complete. Romeo and Juliet has become forever associated with love. The play has become an iconic story of love and passion, and the name â€Å"Romeo† is still used to describe young lovers. Shakespeare’s treatment of love in the play is complex and multifaceted. He uses love in its many guises to thread together the key relationships in the play. In the Laboratory the women’s anger and revenge seems controlled as looking at the structure, all stanzas are end-stopped, indicating some clear structure and thought behind the lady. Hence, any sympathy we had for her almost disappears as she must know she is doing bad being that her state of mind is quite clear.
